[URGENT ANNOUNCEMENT] Recommendation for Local Churches to Apply for IRS 501(c)(3) in Relation to Religious Workers Visa and Green Card Applications Churches and Pastors of the Korean American Annual Conference of the GMC, We are sharing this urgent notification as cases of denial for religious worker (R-1) visas and green card applications for Korean churches affiliated with the Global Methodist Church (GMC) have repeatedly occurred since the latter half of 2025. USCIS's Changed Stance and Current Situation: Since the founding of the GMC denomination in 2022, the IRS 501(c)(3) tax-exempt status of the GMC General Conference has been the basis for religious visa and green card applications for affiliated churches without issue. However, the United States Citizenship and Immigration Services (USCIS) has recently changed its position, presenting a new interpretation that the 501(c)(3) status of the General Conference cannot be extended to cover the GMC local churches. As a result, even cases that had already received initial approval during the religious visa or green card application process are now unfortunately being denied upon re-examination. In one instance, despite initial approval, a church received a final denial notice due to insufficient proof of its own independent 501(c)(3) non-profit status. USCIS is expected to maintain its stance for the foreseeable future that the GMC denomination's 501(c)(3) status cannot substitute for that of local churches. Immediate Need for Local Churches to Apply for 501(c)(3): Given this situation, the Korean American Annual Conference strongly recommends that, for the stable approval of pending or future religious visa and green card applications, each local church directly apply to the Internal Revenue Service (IRS) for 501(c)(3) non-profit status. - Faster Processing Time: While the 501(c)(3) approval process for denominations or annual conferences has historically taken longer, applications from local churches are often completed within 4 to 6 weeks.
- Maintaining Denominational Affiliation: Even when applying for 501(c)(3) individually, it remains essential to declare affiliation with the denomination and obtain necessary documentation, including signatures from denominational officials.
The Annual Conference's Efforts and Search for Solutions: Our Korean American Annual Conference has also obtained 501(c)(3) non-profit status from the IRS, but we cannot rule out the possibility of a similar interpretation from USCIS as is being applied to the General Conference office. Therefore, the Annual Conference, in close cooperation with the General Conference office, plans to pursue diverse efforts to resolve this issue with the assistance of specialized immigration attorneys. We recognize that changes in the U.S. administration's immigration policy and efforts at the Congressional level will be necessary. Ultimately, we plan to work towards securing Group Exemption status from the IRS for all churches within the GMC. An Urgent Appeal to Local Church Leaders: Regardless of these efforts by the GMC denomination and the Annual Conference, it is extremely urgent for each local church to apply for its own IRS 501(c)(3) non-profit status to minimize the risk of existing religious visa or green card cases being canceled or denied. We earnestly request that you proceed with this process expeditiously to prevent potential administrative difficulties and disruptions to your vital ministry.
